Deep Dive: The EU AI Act in 2026

The EU AI Act entered into force on 1 August 2024. Its obligations phase in on a timeline that makes 2026 the decisive compliance year.

February 2025: Prohibited AI practices banned (social scoring, untargeted facial recognition scraping, emotion recognition in workplaces and schools). AI literacy obligations begin for all providers and deployers.

August 2025: Governance infrastructure operational. General-purpose AI (GPAI) model obligations begin. Member States designate national competent authorities. AI Office, AI Board, and Scientific Panel operational.

August 2026: High-risk AI system rules (Annex III) take effect. Transparency obligations (Article 50) enforceable. Full enforcement begins at national and EU level. Member States must have at least one AI regulatory sandbox.

August 2027: High-risk AI systems embedded in regulated products (Annex I) must comply. Pre-August 2025 GPAI model providers must be fully compliant.

For US organisations, the extraterritorial reach is the critical consideration. Any company placing AI systems on the EU market or deploying AI within the EU must comply regardless of where the company is headquartered. Penalties reach €35 million or 7% of global annual turnover for prohibited practices, €15 million or 3% for other violations.

High-risk system obligations include: risk management systems throughout the lifecycle (Article 9), data governance practices (Article 10), technical documentation (Article 11), record-keeping and logging (Article 12), transparency and information provision to deployers (Article 13), human oversight measures (Article 14), and accuracy, robustness and cybersecurity requirements (Article 15).

Deep Dive: NIST AI RMF and Its Expanding Ecosystem

The NIST AI RMF 1.0 (NIST AI 100-1), released January 2023, established the foundational architecture: four interconnected functions that organise all AI risk management activities.

Govern is the cross-cutting function establishing policies, accountability, risk tolerance, and organisational culture. It informs and is embedded within the other three functions.

Map identifies context, stakeholders, intended purposes, and potential impacts. It produces the contextual knowledge needed for go/no-go decisions on AI system development or deployment.

Measure employs quantitative and qualitative tools to assess risks including bias, explainability, security, and performance. It translates contextual understanding into measurable indicators.

Manage allocates resources to address risks, implements controls, establishes incident response, and maintains post-deployment monitoring with defined intervention triggers.

What has changed since 2023 is the ecosystem surrounding the core framework. The Generative AI Profile (AI 600-1, July 2024) identifies 12 risk categories specific to large language models and multimodal systems: confabulation, data privacy, environmental impact, information integrity, intellectual property, toxic content, and six others. The Cyber AI Profile (IR 8596, preliminary draft December 2025) bridges AI risk management with the Cybersecurity Framework 2.0 across three focus areas: securing AI systems, using AI for cyber defence, and defending against AI-enabled threats. The SP 800-53 Control Overlays for Securing AI Systems (COSAiS, concept paper August 2025) provide implementation-level controls.

The NIST AI RMF does not have formal certification. It is voluntary. But its influence exceeds its voluntary status.
